Ryan S. McPhee

Ryan S. McPhee leads Kritzer McPhee’s patent and trademark prosecution practice, concentrating his practice on obtaining registered protection of clients’ intellectual property and technology rights. Ryan leverages his relationships with foreign law firms and specialized vendors to develop global IP portfolios for clients at competitive costs. Ryan is always happy to take the time to educate clients on legal principles and procedures critical to protecting their intellectual property.

Mr. McPhee started his career obtaining patents involving electro-mechanical products and manufacturing technologies.  He then quickly gained experience supporting litigation involving advanced electronics, telecommunications, and financial system technologies.  Mr. McPhee further expanded into appellate work, post-grant proceedings at the United States Patent & Trademark Office, and rendering of detailed legal opinions applying principles of patent law to specific technologies for clients at risk of litigation.  In recent years, Mr. McPhee has obtained and litigated design patents in what has become a growing field of patent law.  With such broad experience, he can now reliably advise clients how action taken early on may impact proceedings much later down the line.

Trademarks form a substantial component of Mr. McPhee’s practice, both domestically and internationally.  He has built large portfolios of registrations for clients, sometimes over the objection of formidable opponents.  He has extensive experience counseling clients on selecting marks that are both eligible for registration and capable of strong protection.  He leverages his long-time relationships with foreign law firms to provide clients with reliable and cost-effective advice and strategies for protecting and enforcing trademark rights around the world.

The rest of Mr. McPhee’s practice involves copyright and contract services.  Specifically, Mr. McPhee litigates copyright infringement claims in federal court, both on behalf of content-creators and on behalf of accused infringers.  Mr. McPhee has negotiated countless Non-Disclosure Agreements for clients to facilitate potential licensing, sales, or joint ventures.  When clients reach an agreement in principle, Mr. McPhee has prepared and negotiated intellectual property licenses and sales agreements to close the deal.  When clients have run into trouble, Mr. McPhee has also helped resolve breach of contract disputes, through both litigation and out-of-court settlements.

Mr. McPhee has represented banks, specialized manufacturers, computer security firms, research & development entities, fitness companies, utility companies, doctors, dentists, real estate firms, healthcare companies, NFT enterprises, fragrance houses, jewelers, wineries, and a variety of suppliers, distributors, and retailers in a wide range of industries.  From his office in Southern California, Mr. McPhee serves clients across the United States and in Europe, Asia, and Australia.
